  • Unemployment
  • Paid Family Leave
  • Short-term disability
  • Workers compensation
New York State has a fiduciary duty to ensure it has collected from all appropriate sources to pay these benefits. It may choose to penalize now and reconsider later if:
  • Your independent contractor files for benefits and names you as an employer, instead of a client
  • That contractor is not an independent business owner with a contract
  • You have been paying the contractor under a SSN, rather than a EIN or TIN
